DHS chief calls for 5,000 more border agents, end of ‘catch-and-release’ policies

Homeland Security Secretary John Kelly has called for increased Border Patrol agents and the end of so-called “catch-and-release” policies.

In two memos issued Tuesday, the DHS took steps toward implementing President Donald Trump’s immigration-related executive order, which called for the removal of people in the U.S. illegally who “have been convicted of any criminal offense,” “have been charged with any criminal offense,” “have committed acts that constitute a chargeable criminal offense” or “are subject to a final order of removal.”

Kelly instructed the DHS to hire 5,000 additional Border Patrol agents in an effort to meet the White House’s broadening of the federal government’s priorities regarding the deportation of illegal immigrants. In addition, he called on Immigration and Customs Enforcement to hire 10,000 new officials to tackle increased immigration enforcement.

The biggest shift, though, is in Kelly’s order to end “catch-and-release” policies that allow illegal immigrants to remain freely in the U.S. while they await hearings on their legal status in the future.

“If an immigration officer determines that an arriving alien is inadmissible to the United States under [existing law], the officer shall, consistent with all applicable laws, order the alien removed from the United States without further hearing or review, unless the alien is an unaccompanied alien child,” the memo reads.

The memorandum also makes allowances for those applying for asylum in the United States.

Asylum seekers must establish to immigration officials that they have a “‘credible fear’ of persecution or torture” in returning to their home country. The immigrant must also make clear they present “neither a security risk nor a risk of absconding and will “comply with any additional conditions of release imposed by ICE to ensure public safety and appearance at any removal hearings.”

Kelly also called on all state and local law enforcement departments to comply with immigration enforcement protocol, instructing high-level DHS officials “to engage immediately with all willing and qualified law enforcement jurisdictions” to organize immigration enforcement activity.

“Empowering state and local law enforcement agencies to assist in the enforcement of federal immigration law is critical to an effective enforcement strategy,” Kelly wrote.

The push to engage state-level and local agencies follows Trump’s executive order directing all federal law enforcement agencies to “employ all lawful means” to enforce current immigration laws and make sanctuary cities ineligible for federal funding.

A sanctuary city is a municipality that that blocks local funds or resources from being used to enforce federal immigration laws, thereby providing safe haven to immigrants living in the city illegally.

There’s no question about it; President Trump is a “doer” who is dedicated to keeping his promises.

So much so that his administration is pushing for FASTER deportations.

One way they’re doing that is by adding 10 thousand new agents, however, they’re streamlining the process further and making swift work of deporting criminal illegals.

Illegal advocates are left to contemplate their next move, as Phoenix shoots down the option to become a “sanctuary city.”

The Phoenix City Council cited a 2010 Arizona immigration law, SB1070, as they rejected a measure that would turn the state’s capital into a sanctuary city.

Citing Arizona’s 2010 immigration law, SB1070, the Phoenix City Council shot down a measure that would have turned the state’s capital into a sanctuary city.

Although portions of SB1070 were struck down by the Supreme Court in 2012, the provision that prevents any jurisdiction within the state from harboring illegal aliens remains in effect.

The measure failed on a 7-2 vote Wednesday after a heated debate.

Facing possible pushback from constituents in addition to jeopardizing millions in federal funds, Phoenix Mayor Greg Stanton, a Democrat, made the motion to deny the request, although he said he opposes President Donald Trump’s immigration policies.

“We must respect the Supreme Court’s unanimous decision and the rule of law — and I will not ask Phoenix police officers to knowingly violate the law,” Stanton said.

The petition was brought before the City Council by Phoenix resident Rick Robinson in direct response to Trump’s executive order allowing immigration officials to begin pursuing deportations in earnest.

According to Robinson, the motion would have forced city officials to get “off the fence” and determine how they wish to proceed in light of the new administration.

“That’s the only way the Police Department will know how to pursue their duties,” he said.

While both Stanton and the City Council refused to support the petition on the basis of legal compliance, they vowed to re-examine possible workarounds during the upcoming executive session.

Memos released Tuesday by the Department of Homeland Security direct agency employees to begin immediately implementing President Donald Trump’s executive orders on immigration and border security.

One of the memos calls for the immediate construction of a wall along the Mexican border.

The other memo declares that President Barack Obama’s executive amnesty program, known as Deferred Action for Childhood Arrivals (DACA), is not to be affected by Trump’s executive orders.

The two memos were signed Monday.

On the campaign trail, Trump pledged to get rid of Obama’s amnesty for illegal immigrants who were brought to the U.S. as children. He has yet to fulfill this goal.

“DACA is a very, very difficult subject for me,” the president said during a press conference last week. “It’s one of the most difficult subjects I have because you have these incredible kids.”

More than 1.5 million illegal immigrants have received protection from deportation, work permits, a Social Security number and access to welfare since the implementation of DACA in 2012. The memos released Tuesday do fulfill several of Trump’s other campaign promises.

One of the two memos states, “A wall along the southern border is necessary to deter and prevent the illegal entry of aliens and is a critical component of the President’s overall border security strategy.” The memo orders Customs and Border Protection (CBP) to use materials originating in the U.S. to “immediately begin planning, design, construction and maintenance of a wall, including the attendant lighting, technology (including sensors), as well as patrol and access roads, along the land border with Mexico in accordance with existing law.”

The memos order the hiring of an additional 10,000 ICE officers and 5,000 CBP officers. They also get rid of an Obama administration program which forced ICE to focus on deporting only the most serious of criminals, and reinstate the 287(g) program which allows for local and state law enforcement officials to enforce federal immigration law.
