The Biden regime’s determination to betray the American people and remake America has reached a new level. They now want the U.S. Supreme Court to remove a critical obstacle installed by Texas to stop illegal border crossings, leaving the state defenseless against the illegal alien invasion.
As CNN reported, the Biden regime wants border agents to have the authority to cut razor wire that Texas has installed on the banks of the Rio Grande to deter border crossers. Texas Governor Greg Abbott’s administration installed the razor wire near the Rio Grande River at Eagle Pass, Texas, to slow the illegal alien invasion that has overrun the state. Crime has skyrocketed, property has been destroyed, and precious state resources are being drained, all thanks to the Regime’s open borders policy.
When Border Patrol agents caved to the Regime’s dictates and cut through some of the razor wire last October, Texas State Attorney General Ken Paxton sued. He correctly argued this action destroys state property and undermines security to assist illegal aliens in crossing the border.
A federal judge declined to impose an injunction against the federal government. The conservative Fifth Circuit Court of Appeals, however, stepped in and granted Texas a temporary victory last month, ordering Border Patrol agents to stop the practice while legal proceedings unfold.
Biden’s Department of Injustice struck back on Tuesday, filing an emergency application that demanded the Supreme Court reverse the ruling. U.S. Solicitor General Elizabeth Prelogar wrote in the court filing that Border Patrol agents have authority under federal law to access private land at the border and that Texas has no right to stop them from carrying out their “duties.”

President Joe Biden’s Department of Justice (DOJ) is vowing to sue Texas if state officials begin carrying out a new set of laws, signed by Gov. Greg Abbott (R), that allows them to have illegal aliens arrested and deported — independent of federal officials.
Last week, Abbott signed three pieces of legislation into law, including giving state law enforcement the power to arrest illegal aliens for the crime of illegally crossing the United States-Mexico border and local judges the authority to have illegal aliens deported.
The landmark laws are significant because they put Texas on the map as the first state in the nation where residing illegally in the United States is a state crime, not just a federal crime.
In response, Biden’s DOJ is threatening to sue Texas unless Abbott promises by January 3, 2024, not to enforce the new laws, according to a letter from Principal Deputy Assistant Attorney General Brian Boynton reviewed by the Houston Chronicle:
The new legislation, which Abbott signed into law earlier this month, is unconstitutional and will disrupt the federal government’s immigration enforcement operations, Principal Deputy Assistant Attorney General Brian M. Boynton wrote in a letter to the governor obtained by Hearst Newspapers.

The DOJ letter says the U.S. Constitution tasks the federal government with regulating immigration and controlling the international borders. The law “therefore intrudes into a field that is occupied by the federal government and is preempted,” the letter says. [Emphasis added]
The Justice Department points to a landmark Supreme Court ruling from 2012 that held that only the federal government has the power to enforce immigration laws. Abbott has cast the law as an opening for the high court to reconsider that ruling. [Emphasis added]

Gov. Greg Abbott traveled to the Rio Grande Valley on Monday to sign into law three bills that pour more money into his three-year effort to deter illegal immigration at the Texas-Mexico border and give Texas law enforcement authority to arrest undocumented immigrants anywhere in the state.
Senate Bill 3 earmarks $1.54 billion in state money to continue construction of barriers along the 1,200-mile border, and allows the state to spend up to $40 million for state troopers to patrol Colony Ridge, a housing development near Houston that far-right publications claim is a magnet for undocumented immigrants.
The money would be added to at least $1.5 billion in contracts the state has issued since September 2021 to build about 40 miles of border barrier. As of August, Texas had erected 16 miles of steel bollard barriers in Starr, Cameron, Val Verde and Webb counties.
Senate Bill 4 creates a state crime for illegally crossing the border from Mexico — a new law that is likely to force a legal showdown with the federal government.
Another Senate Bill 4 — this one passed by lawmakers during the third special session earlier this year — would increase the minimum sentence from two years to 10 years for smuggling immigrants or operating a stash house.
The laws funding the border barrier and making crossing illegally a state crime go into effect in early March. The human smuggling law goes into effect in early February.
Abbott, who was in Brownsville on Monday to sign the bills, said Texas needs to defend itself from drug cartels, blaming the Democratic President Joe Biden administration’s immigration policies.
“Biden’s deliberate inaction has left Texas to fend for itself,” Abbott said.
