Joe Biden Said Subpoena Defiers Should Be Charged. Will His DOJ Arrest Hunter Biden?

Hunter Biden defied a congressional subpoena on Wednesday, an action his father has previously said should be prosecuted.

President Joe Biden said in October 2021 that individuals who defy subpoenas from the January 6 House Select Committee should be prosecuted, and the Justice Department indicted Steve Bannon for doing so in November 2021. Legal experts said the president’s son could be, but for various reasons may not be, likewise prosecuted by the Biden Justice Department for his choice to hold a press conference on Capitol Hill instead of sitting his deposition before the House Oversight Committee.

Criminal defense attorney and legal analyst Philip Holloway told the Daily Caller News Foundation that the law “must be applied equally or it has no meaning.”

“Hunter Biden needs to be held to the same standard as other recent people who have thumbed their noses at congressional subpoenas,” Holloway said. “In this case, however, Hunter went so far as to show up on Capitol grounds and hold a press conference, thereby figuratively giving the middle finger to the House of Representatives. It is imperative that he be cited for contempt and that he be prosecuted by the U.S. attorney just as was the case recently with Bannon.”

Holloway called dodging a valid subpoena “just stupid,” noting Hunter could have “invoked the Fifth Amendment” at his deposition.

The younger Biden’s business relationship with Chinese infrastructure firm CEFC started in October 2015 and translated into lucrative financial rewards immediately after his father left office in January 2017, according to bank records, emails, texts and testimony made public by House investigators in addition to legal documents produced by federal prosecutors.

“In the late fall of 2015, the Defendant, Business Associate 1, and Business Associate 2 began to investigate potential infrastructure projects with individuals associated with CEFC China Energy Co Ltd. (CEFC), a Chinese energy conglomerate,” reads a federal indictment against Hunter Biden in the Central District of California.

Then-Vice President Biden announced in October 2015 he would not run for president after months of speculation, Politico reported at the time. Democratic party operatives and then-President Obama himself encouraged Biden not to run for president against former Secretary of State Hillary Clinton in the 2016 Democratic primary, according to multiple reports and Joe Biden’s 2017 book, “Promise Me Dad” written in the wake of his late son Beau Biden’s death in May 2015 from brain cancer.

Former acting Attorney General Matthew Whitaker, told Newsmax, he believes the Justice Department will not prosecute Hunter Biden on a contempt of Congress charge.

Whitaker made his comments Friday on “Wake Up America.”

“I think ultimately they don’t [prosecute] because this Merrick Garland and this Department of Justice are probably unwilling to go against Hunter Biden and Joe Biden — their bosses. They need to demonstrate there’s not a two-tier system of justice,” he said.

Hunter Biden skipped his House Oversight Committee subpoena to provide a closed-door deposition earlier this week.

Whitaker said the House investigation of Hunter Biden and his family was warranted.

“It’s really about his behavior and his actions and what he did,” he said. “At the end of the day, he benefited millions of millions of dollars when his father was vice president. That is obviously a concern that those were [from] corrupt relationships, that they were only giving him money to benefit his father and to have access to his father.
