Donald Trump’s lawyers intend to appeal his $83.3 million defamation lawsuit loss to E. Jean Carroll by arguing there was an ‘insane’ conflict of interest at the heart of the case.

The former president’s legal team are set to appeal on the grounds there was a conflict of interest between Carroll’s lawyer and the judge presiding over her case.

Trump’s firebrand attorney Alina Habba claimed she was unaware that Judge Lewis Kaplan and Carroll’s lawyer Roberta Kaplan – who are not related – worked together in the early 1990s, with the judge serving as her ‘mentor’, reports the New York Post.

‘It was never disclosed. It’s insane and so incestuous,’ Habba said, arguing their alleged close relationship was never disclosed and she only became aware of it after the conclusion of the case.

Habba continued: ‘This is news to us. We are going to include this in our appeal and take appropriate measures. The fact it wasn’t disclosed is an ethics violation.’

The allegations of a conflict of interest were bolstered by an anonymous former Weiss partner, who reportedly claimed Roberta Kaplan – a junior associate – made an extra effort to stand out to the managing partners.

‘Lew was like her mentor,’ they claimed.

Before becoming a founding partner at law firm Kaplan, Keckler & Fink in 2016, Roberta Kaplan worked alongside the judge at Paul, Weiss Rifkin, Wharton & Garrison in Manhattan.

She began at the firm in 1992, according to her LinkedIn, where Judge Kaplan was a partner until he was appointed to the federal bench by President Bill Clinton in 1994.

In a statement to the Post, representative for Roberta Kaplan, Zak Sawyer, denied there was any conflict of interest and said the two barely knew each other.

‘They overlapped for less than two years in the early 1990s at a large law firm when he was a senior partner and she was a junior associate and she never worked for him,’ he said.

E. Jean Carroll’s second defamation lawsuit closed on Friday as a New York jury determined that former President Donald Trump owes her $83.3 million for defaming her in 2019. However, what has continually fallen under the radar is the fact that there are serious concerns with the woman’s entire story. Yet, she was awarded tens of millions of dollars.

Carroll originally came out with her story in 2019, detailing the alleged incident, claiming that Trump sexually assaulted her in a Bergdorf-Goodman dressing room in the mid-1990s: “Carroll said Trump followed her to a fitting room at the store, shoved her against a wall, pulled down her tights and, ‘forcing his fingers around my private area, thrusts his penis halfway — or completely, I’m not certain — inside me.’”

Trump has vehemently denied the allegation over the years, prompting these defamation suits by Carroll.

“It’s just as bad for people to believe it, particularly when there is zero evidence,” Trump said in 2019 when the allegations first arose. “Worse still for a dying publication to try to prop itself up by peddling fake news — it’s an epidemic.”

“If anyone has information that the Democratic Party is working with Ms. Carroll or New York Magazine, please notify us as soon as possible,” Trump wrote. “The world should know what’s really going on. It is a disgrace, and people should pay dearly for such false accusations.”

Despite the odd things about Carroll’s story — and a stunning lack of evidence — she was awarded tens of millions of dollars, which Trump supporters say shows just how scary the justice system has become if one is a targeted individual.

Jean Carroll went on CNN with her attorney Roberta Kaplan went on with CNN to brag about how Carroll was only able to file the lawsuit after New York Democrats changed the laws and extended the statute of limitations for sexual assault in the state. This allowed E. Jean Carroll to sue Trump for a rape she said took place in a department store sometime in the 1990s during a shopping spree with the younger Donald Trump. She didn’t even have to give a date or a year to get the case to court in New York City.

Governor Hochul signed the act into law in May 2022 so that E. Jean Carroll could file her lawsuit against President Trump.

On May 24, 2022, Governor Kathy Hochul signed the Adult Survivors Act (ASA) into law, which gives survivors of sexual assault an opportunity to heal and seek justice.

The Adult Survivors Act creates a special one-year look-back window to allow survivors whose case or claim expired outside the statute of limitations, and who were 18 or older when they were sexually assaulted in New York State, to file a lawsuit against the person who harmed them and/or the negligent institution.

The one-year window will begin on November 24, 2022 and will allow survivors to sue, even if they were already outside of the civil statute of limitations.

Carroll could not win a rape case against Trump so her team took him to court for “defamation” for the comments he made as president. This sets a dangerous precedent for future presidents as the left continues its assault on the First Amendment.
