Boston’s progressive ‘sanctuary city’ laws allowed a Haitian man who allegedly came to America illegally to be set free despite being arrested for rape and indecent assault of a developmentally disabled person.

Pierre Lucard Emile, 31, is the suspect in question, according to multiple officials inside Immigration and Customs Enforcement.

When Boston immigration officials demanded he be detained after being charged on the grounds that he is here illegally, they were denied by a district court judge.

Due to the city’s sanctuary laws, ICE detainer requests are frequently ignored. In 2022 alone, Boston Police didn’t honor 100 detainer requests, according to the Boston Globe.

The city’s Trust Act, passed under Democrat and former Biden administration official Marty Walsh and upheld by current progressive Mayor Michelle Wu, forbids city agencies from cooperating with certain ICE requests.

ERO Boston Field Office Director Todd M. Lyons claims that the court is getting in the way of allowing ICE to protect the city.

‘Disturbingly and despite our filing an immigration detainer, this individual was released back into the community by the criminal court,’ he told Fox News.

‘The men and women of ERO Boston continue to protect the community from those who pose a real public safety threat to our communities,’ Lyons added.

Emile arrived at the port of entry in Brownsville, Texas, where he was deemed inadmissible and ordered to appear before the DOJ’s Office of Immigration Review in Boston, according to ICE.

Just nine months later, he was arrested for the rape and indecent assault and battery on a developmentally disabled person.

He had been held at a non-ICE detention center in Boston for two months before being released on November 8 with an electronic monitoring device.

ERO Boston, which handles immigration offenses in the region, arrested Emile January 9 in Dorchester after they were tipped off to his migrant status.

Emile is still in ICE custody pending a hearing from a DOJ immigration judge, while charges remain pending with a local criminal court in the rape and assault case.

An illegal immigrant from Haiti who was arrested on rape charges was released back into his community in Boston, according to Immigration and Customs Enforcement.

In a press release, Immigration and Customs Enforcement (ICE) said that the 31-year-old Haitian national was arrested on charges of raping a “developmentally disabled person” and confirmed that he was released back on the streets (via ICE):

Enforcement and Removal Operations (ERO) Boston apprehended an unlawfully present Haitian national Jan. 9 who was recently arrested by local police on charges of rape and indecent assault and battery on a developmentally disabled person in Dorchester. ERO Boston lodged an immigration detainer against the Haitian citizen, but the Dorchester District Court chose not to honor it and released him from jail after his arrest on the sexual assault-related charges.

“Disturbingly and despite our filing an immigration detainer, this individual was released back into the community by the criminal court,” said ERO Boston Field Office Director Todd M. Lyons. “The men and women of ERO Boston continue to protect the community from those who pose a real public safety threat to our communities. We remain strongly committed to protecting residents in communities by apprehending those who are not lawfully present in this country and pose a threat to public safety. An illegal Honduran immigrant charged with rape, kidnapping and assault was released onto the streets in Virginia, despite a request by Immigration and Customs Enforcement (ICE) to hold him until it could take him into custody to deport him. He was free for nearly two months until ICE was able to arrest him.

ICE announced in a recent press release that it arrested the unnamed Honduran national, charged on Oct. 12, nearly two months after he had been freed from an adult detention center in Fairfax County, Virginia.

The illegal immigrant had entered the U.S. and was arrested by Border Patrol in Texas in June 2021 and released into the country with a Notice to Appear.

In July 2023, he was arrested and charged in Herndon, Virginia, with felony rape by force, threat or intimidation; abduction by force; and assault on a family member. The same day, ICE’s Washington D.C., branch issued a detainer — a request that ICE be alerted when an illegal immigrant is being released from custody in order to move them into deportation proceedings.

However, despite the severity of the charges against him, and the detainer placed on him by ICE, the agency determined on Aug. 17 that the Fairfax County Adult Detention Center released him without letting them know. He was eventually arrested last month in Herndon, Virginia.

ICE criticized the decision not to alert them to the alleged illegal immigrant rapist’s release.

“This undocumented Honduran national has proven to be a detriment to our community and a threat to Virginia residents,” said Russell Hott, Washington D.C., field office director of ICE’s Enforcement and Removal Operations (ERO).

“ERO Washington remains committed to apprehending criminals who are released back into the local population when a detainer is not honored. We will not allow such noncitizen offenders to roam free and victimize innocent people.”
