Jack Smith Opposes News Media Bid to Intervene in Trump Classified Documents Case

The Press Coalition didn’t identify any statutory right to intervene in the case, according to prosecutors.

Special prosecutor Jack Smith’s office on Feb. 5 opposed a motion by a coalition of local and national news media seeking to intervene in former President Donald Trump’s classified documents case in Florida.

Prosecutors argued that the Press Coalition lacked standing and that their request to unseal certain court records, which might be favorable to the former president’s defense, was already addressed by a previous defense motion.

The Associated Press, The New York Times, NBC News, and other news media, referred to as the Press Coalition in court documents, requested the court’s permission to participate in the ongoing legal proceedings on Jan. 22.

Mr. Smith’s office, in its Feb. 5 motion, formally opposed the Press Coalition’s request to join the litigation, saying they didn’t identify any statutory right to intervene in the case.

The Press Coalition’s interest in the case “is ancillary to the main proceedings,” the prosecutors argued. They seek transparency and “access to information.”

Legal observers are growing increasingly worried that former President Trump’s criminal prosecution related to an allegedly lawless campaign to overturn the 2020 election could be delayed past November, which could help bolster his efforts to return to the Oval Office.

And now, with an appeals court weighing whether he’s protected from prosecution by presidential immunity, Trump’s goal of facing voters before he faces a federal jury is growing likelier with the judge issuing a full stop on trial proceedings in Washington until that determination is made.

“I am officially now at the freakout stage,” Obama-era acting U.S. Solicitor General Neal Katyal told MSNBC on Sunday.

Anticipation had run high that the three-judge D.C. Circuit Court of Appeals panel would rule quickly, as the panel agreed to expedite the case and directed the attorneys to file their written briefs on the Saturdays preceding Christmas and New Year’s, no less.

But four weeks after oral arguments, the panel has still not handed down their decision.

Special counsel Jack Smith wanted to know whether former President Donald Trump hid even more classified national security documents in a locked closet at his Mar-a-Lago estate, according to a new report.

The “hidden room” apparently wasn’t opened by FBI agents who executed a search warrant on Aug. 8, 2022, and seized 102 sensitive intelligence files at Trump’s residence in Palm Beach, Fla., sources told ABC News.

The 45th president, 77, allegedly had a resort employee change the locks on the closet as one of his attorneys checked a basement storage room in a bid to comply with a federal subpoena and turned in some of the documents before the search, the sources said.

The room is reportedly located in Trump’s bedroom behind a dresser and TV.
