Progressives Flip Out Over Arizona Ballot Referendum to Let Border Police Arrest Illegals

Readers are likely familiar with the efforts by the state of Texas and Republican Governor Greg Abbott–despite the Biden administration’s lackadaisical attitude on the matter–to combat the swelling horde of illegal aliens crossing the nation’s Southern border. The feds have even sued the state for daring to follow existing law about people trespassing our sovereign border, something that is still tied up in the courts.

But that is not the only U.S. state forging ahead when the Democrats have failed to fulfill one of their primary jobs in Washington, D.C.– keeping Americans safe and securing the border. After approval by the statehouse, on Tuesday, Arizonans will now have a chance to vote on a referendum this fall that would substantially reduce the illegal entry into the Copper state from Mexico.

PHOENIX (AP) — The Republican-controlled Arizona Legislature gave final approval Tuesday to a proposal asking voters to make it a state crime for noncitizens to enter the state through Mexico at any location other than a port of entry, sending the measure to the Nov. 5 ballot.

The potential referendum, which legislators passed 31-29, lets police department personnel near the border arrest illegal aliens “crossing the border without authorization.” The law, if passed, would also empower state courts to deport illegals back to their home countries:

 The backers also say the measure focuses only on the state’s border region and — unlike Arizona’s landmark 2010 immigration law — doesn’t target people throughout the state. Opponents point out the proposal doesn’t contain any geographical limitations on where it can be enforced within the state.

PHOENIX (AP) — The Republican-controlled Arizona Legislature gave final approval Tuesday to a proposal asking voters to make it a state crime for noncitizens to enter the state through Mexico at any location other than a port of entry, sending the measure to the Nov. 5 ballot.

The vote came as President Joe Biden unveiled plans Tuesday to restrict the number of migrants seeking asylum at the U.S.-Mexico border, saying “This action will help to gain control of our border, restore order to the process.”

Arizona’s proposal, approved on a 31-29 vote by the state House, would allow state and local police to arrest people crossing the border without authorization. It would also give state judges the power to order people convicted of the offense to return to their countries of origin.

The proposal bypasses Democratic Gov. Katie Hobbs, who had vetoed a similar measure in early March and has denounced the effort to bring the issue to voters.

Arizona voters will now decide on a ballot measure that could allow local law enforcement to arrest people suspected of illegally crossing the border and give local judges the power to issue deportation orders.

The Arizona House voted Tuesday to put the measure on the general election ballot in November. Republicans have a one-vote majority in the chamber, and the measure passed along party lines.

If approved by voters, HCR 2060 would make it a state crime to cross the Arizona-Mexico border outside of official ports of entry. Local law enforcement agencies would be able to make arrests, and local judges would be allowed to order those convicted to leave the country.

The Arizona Senate passed the measure on May 22 after amending it to specify that law enforcement must have probable cause — such as witnessing a crossing or having video evidence — to make an arrest. And the border-crossing provision will not apply to anyone who crosses the border without authorization before the law takes effect.

The proposal is based on a Texas law that similarly makes it a state crime to enter that state illegally. However, an appeals court has blocked implementation of the Texas law while lawsuits filed by the U.S. government and the ACLU are being heard.
