On Friday, Donald Trump’s legal team filed an appeal aimed at reversing a decision by a Fulton County judge in Georgia, permitting District Attorney Fani Willis to continue prosecuting the criminal racketeering case against the former president and eight co-defendants.
The 51-page motion submitted to Georgia Court of Appeals argues for clarity on the issue of “forensic misconduct,” under Georgia law that requires disqualification for certain acts of prosecutors. The appeal asserts that the trial judge, Scott McAfee, erred in not finding an actual conflict of interest. This argument hinges on Willis’ concealment of her romantic relationship with special prosecutor Nathan Wade. The appeal contends that this relationship, coupled with Willis’ conduct and statements, has tainted the case with bias and impropriety.
Specifically, the appeal criticizes a speech by Willis, dubbed the “church speech,” a 35-minute address before the Big Bethel AME Church, where she injected racial bias into the case and implied divine favor in her prosecution efforts. The filing argues,
While concealing her personal relationship with … Wade, improperly injected race and racial bias into the case, indicating that defendants and their counsel were racists for challenging her unethical conduct, that Defendants were guilty and would be convicted (boasting about her ‘superstar’ team with a ‘conviction rate of 95 percent’) … and implying that God himself had chosen her for this case, that he was on her side, and that she was doing His work in this prosecution.

RELATED: Trump Appeals Ruling Allowing Willis to Remain on Election Case
Published March 30, 2024
Former President Trump and eight co-defendants asked a state appeals court on Friday to review a judge’s ruling allowing Fulton County District Attorney Fani Williams to stay on the election interference case.
As Mia reported earlier this month, Willis was allowed to remain so long as her former paramour, special prosecutor Nathan Wade, resigned.
“DA Willis has covered herself and her office in scandal and disrepute, as she has squandered her credibility and repeatedly and flagrantly violated the heightened ethical standards demanded of her position,” the appeal states.
On Friday, Trump and eight of his co-defendants filed an application with the Georgia Court of Appeals urging it to take up the case, insisting Willis has a personal stake in the case and must step aside. The move was expected after McAfee handed down a decision enabling the defense to attempt to appeal his ruling before trial.
“While the trial court factually found DA Willis’s out-of-court statements were improper and Defendants proved an apparent conflict of interest, the trial court erred as a matter of law by not requiring dismissal and DA Willis’ disqualification,” the application reads. “This legal error requires the Court’s immediate review.”
The court’s rules gives the district attorney’s office 10 days to respond to the application.

Former President Donald Trump and his co-defendants in Georgia are once again attempting to get Fulton County District Attorney Fani Willis thrown off the ex-president’s election subversion case.
Judge Scott McAfee allowed Willis to stay on the case earlier this month after former Trump staffer and co-defendant Michael Roman accused her of having an affair with special prosecutor Nathan Wade. The case moved forward with Willis following Wade’s resignation.
In a new court filing on Friday, Trump’s attorneys appealed the decision, arguing that “the trial court erred as a matter of law by not requiring dismissal and DA Willis’ disqualification.”
The Context:
Trump and several of his associates were charged by Willis’ office last year with multiple felonies for an alleged plot to overturn President Joe Biden‘s 2020 election win in Georgia.
