Trump kept on California GOP primary ballot despite 14th Amendment call to remove him

The Democratic lieutenant governor had called for him to be ruled ineligible.

California Secretary of State Shirley Weber has kept Donald Trump on the 2024 Republican primary ballot despite calls from the state’s Democratic lieutenant governor to consider declaring him ineligible under Section 3 of the 14th Amendment.

Thursday was the deadline for Weber, also a Democrat, to certify the official candidate list for California’s March 5, 2024, presidential primary election.

Trump was included among the slate of certified Republican candidates released by the secretary’s office Thursday evening, not long after Maine’s Democratic secretary of state ruled him ineligible for that state’s GOP primary ballot, becoming the second state to do so after Colorado.

Weber has not yet issued an explanation of her decision to include the former president, despite acknowledging last week that she would address the legal questions surrounding the removal of Trump from the GOP primary ballot as requested by Lt. Gov. Eleni Kounalakis.

The Wisconsin Election Commission shot down an effort to remove Donald Trump from the primary ballot under 14th Amendment considerations that have worked so far in two other states.

A Madison brewery owner filed a complaint with the commission on Thursday citing Trump’s actions around the Jan. 6, 2021, riots as insurrection, ergo rendering Trump ineligible to be president. The panel dismissed the complaint later in the day “without consideration” under a previous state ruling that said “it would be nonsensical to have WEC adjudicate a claim against itself.”

“The complaint was disposed of without consideration by the Commission. It is the position of the Commission that a complaint against the Commission, against Commissioners in their official capacities, or against Commission staff, warrants an ethical recusal by the body,” WEC Public Information Officer Riley Vetterkind said in an email statement to media outlets.

Trump was first removed from the Colorado ballot by the Colorado Supreme Court but will remain on the ballot while the appeal before the U.S. Supreme Court is heard. Then Thursday, the Maine secretary of state removed Trump from the ballot there under 14th Amendment pretenses.

Michigan’s Supreme Court has refused to hear an appeal by voters in the US state to disqualify Donald Trump from next year’s presidential primary.

They sought to invoke a clause in the US Constitution, barring anyone who has engaged in insurrection, over Mr Trump’s role in the 2021 Capitol riots.

The decision comes days after Colorado became the first state to rule that Mr Trump was not an eligible candidate.

Michigan is considered a battleground state in the 2024 general election.

Traditionally voting Democrat, Michigan narrowly supported Mr Trump, a Republican, in his successful 2016 presidential campaign. But the state reverted to the Democrats when Joe Biden carried it by a margin of nearly 3% in 2020.

Unlike in Colorado, the Michigan bid failed early on in the process, and the appeal to the state’s supreme court was seen as having little chance of success.

Mr Trump praised the decision on Truth Social on Wednesday, calling it a “pathetic gambit to rig the Election”. The ruling means that his name will appear on the ballot for the Republican primary, set to be held on 27 February.

Pro-democracy advocacy group Free Speech for People filed the lawsuit in September, and the group said in a statement that the ruling was a narrow and technical one that applied only to the state’s Republican primary.

“However, the Michigan Supreme Court did not rule out that the question of Donald Trump’s disqualification for engaging in insurrection against the US Constitution may be resolved at a later stage,” said Ron Fein, Free Speech For People’s legal director.
